An Ohio family has filed a lawsuit against a local funeral home after what they claim was an unimaginable mistake involving their late mother’s remains.

According to court filings viewed by People over the weekend, the family says their mother, Nancy Anders, was cremated by a small-town mortuary in the Buckeye State despite having made very specific plans for her burial — and despite allegedly never authorizing cremation in the first place. WTF?!

The lawsuit, which was just filed this week against Tidd Funeral Home in Hilliard, Ohio, paints a heartbreaking picture of a woman who carefully planned every detail of her final arrangements. After the earlier death of her husband, John “Jack” Anders, Nancy reportedly spent months organizing how she wanted to be laid to rest. The family says her wishes were incredibly detailed because she wanted to be buried alongside her husband at Union Cemetery, People noted.

According to the legal complaint, cremation was completely off the table after Nancy passed away back on May 28, 2025, at the age of 83.

And in fact, the family claims Nancy’s burial plans were SO specific that they required approval from a probate court before she could be buried in the same casket as her late husband. Naturally, that process took time. But the Anders family’s lawsuit alleges that funeral home employees assured the family that the delay would not create any problems, noting this in the filing:

“[The funeral home said that] the delay would not be an issue and that their mother’s body could be kept at their facility for an extended period of time.”

With that reassurance, the family says they waited for the necessary approvals. But when they returned about ten days later, they allegedly received devastating news.

According to the lawsuit, a funeral home employee informed them:

“…there had been an accident and that ‘mom was cremated.’”

WTF???

Can you even imagine hearing those words?

The family says they were horrified because, again, Nancy had evidently made her wishes crystal clear before her death — and her loved ones believed they were carrying out the plans she had carefully arranged. Instead, they now say they are dealing with profound emotional pain and trauma.

The lawsuit states that family members have endured:

“…sleepless nights, suffered physical illness and emotional trauma, serious injury, and experienced severe mental anguish knowing that their mother’s final wishes were ignored and that she had been cremated against her express wishes.”

The family is now seeking monetary damages and has requested a jury trial in the case. Which, whoa! Their legal filing uses especially strong language to describe what they believe happened:

“Defendants’ cremation of Nancy Anders without authorization, knowing that cremation was against her beliefs, was so reckless, extreme and outrageous as to go beyond the bounds of decency and would be considered utterly intolerable in a civilized society. Defendants knew or should have known that cremating Nancy Anders against her wishes would result in serious emotional distress to her family.”

Sheesh. What a passage.

At this point, the legal process will determine what happened and who may be responsible. But still, it’s difficult not to feel for a family that says they went to extraordinary lengths to honor their mother’s final wishes only to learn that those wishes could never be fulfilled.

Such a sad and shocking situation…
